An area transient wanted for an assault warrant faces additional charges after allegedly resisting arrest.
Police say 38-year-old Eugena Simler was charged with Assault involving insulting or offensive contact after allegedly approaching another person near the intersection of Dubuque and Washington streets the evening of August 8th and spitting in their face without provocation. The incident was reportedly caught on camera.
Officers caught up with Simler the morning of September 2nd on the 100 block of East Court Street and had difficulty placing her into custody, She allegedly attempted to pull away from police multiple times and kicked her foot back while being handcuffed, causing pain to an officer’s shin.
Simler also reportedly caused damage to the squad car by kicking it, and then fell to the ground. She allegedly thrashed at officers and threatened to bite them.
The original charge is a simple misdemeanor; Simler was additionally charged with Assault on Persons in Certain Occupations causing Bodily Injury, Interference with Official Acts causing Bodily Injury, and 4th degree Criminal Mischief. With the combined charges, Simler could be sentenced to over 8 years in prison.
