DES MOINES, Iowa (Iowa Media Wire) — The Iowa Supreme Court agreed to hear an appeal of a ruling that declared Orange City’s rental inspection ordinance unconstitutional.
The Iowa District Court for Sioux County made the ruling back in Aug. 2023, saying the ordinance violates the state constitution. Court documents indicate the city enacted the ordinance back in Feb. 2021, which requires landlords and tenants to submit to mandatory inspections of rental properties within the city every five years.
However, those inspections may happen sooner if the city receives complaints of a possible violation during that time frame. City officials could get an administrative search warrant to get into the homes if tenants refused to give them access.
There has not been a date set for the oral argument.
